| RESTRICTIVE AND PROTECTIVE COVENANTS
AND CONDITIONS FOR HAWKE WOODS SUBDIVISION ARE AS FOLLOWS: 1. LOT: The word "Lot" as used herein shall mean the separately numbered parcels as depicted on the recorded plat slide #5628 2. Land Use and Building Type: (a) No structure shall be erected, altered, placed or permitted to remain on any Lot other than for use as a single-family residential dwelling. One single-family residential dwelling shall be erected or permitted to remain upon any Lot less than two acres. (b) Lots larger than two acres may have a total of two dwellings constructed. These multiple dwelling lots must comply with all set back, dwelling size, foundation and construction requirements as listed below. There must be a minimum of 60 feet between each dwelling. Lots that are larger than two acres may also be split into two parcels by their owners in compliance with Henderson County Planning Board regulations. Each parcel resulting from this subdivision must be at least a full acre. If two dwellings are built before the parcel is subdivided the new lot line must allow each dwelling to comply with the setback requirements of the Hawke Woods Subdivision as listed below. (c) No Single-wide or Double-wide mobile homes or On-Frame modular homes shall be placed or permitted on any Lot. A private garage, or outbuildings can be erected if set back 35 feet from the edge of the development road right -of- way. No outbuilding shall be erected upon any Lot unless it is incidental to the residential use of said Lot. 3. Dwelling Constriction: All homes shall be either "Stick Built" on site or manufactured off-frame modular homes, having a minimum 6/12 pitch roof. The Developer reserves the right to review and approve the plans of all proposed homes. 4. Dwelling size: (a) Any one-story dwelling erected upon any Lot shall contain not less than 1,400 heated square feet above grade, exclusive of open porches and garages. (b) Any two-story dwelling erected upon any Lot shall contain not less than 1,600 heated square feet above grade, exclusive of open porches and garages. 5. Foundations: All buildings shall have dressed masonry or brick skirting as foundations. This includes full height of exposed basement walls. All masonry steps and platforms facing the street must also be dressed masonry or skirted in brick. Masonry front landings must be a minimum of 6 x 4 ft. All wooden decks and porches that are not an original part of the home design must be approved by the Developer.
